Following a heated debate on the legal validity of the ballot, Boiko Naidenov was elected acting Prosecutor General by the Supreme Judicial Council on its Tuesday regular session. Fourteen members of the Council voted in favor, six voted against, and three abstained. Deputy Prosecutor General Galina Toneva was the other candidate.
The main argumentative point was whether Boiko Naidenov, being deputy Prosecutor General and recently elected Head of National Investigation Services, is entitled to perform the duties of a Prosecutor General, provided for in the law. Some of the members of the SJC pointed out that pursuant to the relevant legislative provisions, Mr. Naidenov is an investigator, which disenables him from fulfilling the administrative duties of a prosecutor. On the other hand, Mr. Naidenov holds the status of a deputy Prosecutor General. Eventually, he was the one to be elected.
